One of the first issues that needs to be examined in all criminal cases is the legality of the first encounter between the defendant or the accused and the police or law enforcement. That is, if the police did not have “probable cause” or “reasonable and articulable” basis for a defendant’s detention, seizure of any evidence as a result of the arrest will be suppressed, and the D.A. will have a weak case. As such, the more information an accused provides to his counsel, the more likelihood that an error can be found in the case.
Criminal or “penal” charges have varying degrees of ramifications and each one of them are unique. For example, a simple violation or misdemeanor may not carry any jail time, whereas a felony may carry years in jail up to a life sentence.
